Principle / Overview

TAP lab members have a right to privacy within TAP lab, this policy outlines the photography and recording controls TAP lab has put in place to ensure our members and visitors feel comfortable within TAP lab.

Application

This policy applies to anyone who makes use of, or installs cameras within TAP lab or at TAP lab events.

Reason for policy

TAP lab members and visitors have a right to privacy within TAP lab, many of our members prefer not to have photos taken, prefer to remain anonymous, or like to have control over where their likeness is published. This policy sets out how cameras are to be operated within TAP lab or at TAP lab events.

Policy details/Implementation

This policy does not apply to any person taking images who is not taking those images on behalf of TAP lab except where a person is taking images of an identifiable minor who is not affiliated with that person, in which case consent must be obtained from the minor and their guardian.

Consent

The requirements for consent do not apply to:
  • The operation of special use cameras.
  • Public spaces where there is no reasonable expectation of privacy, except if the person taking images influences an already occurring activity to obtain the image o In the case of public spaces, the person operating the camera should endeavour to obtain consent wherever an individual is the primary focus of a photo or recording.
    • TAP lab is not considered a public space for the purposes of consent exemption.
Notwithstanding the above: 
  • Before any photo or recording is taken one of the following conditions must be true:
    • Explicit consent must be obtained from every person who is identifiable in a photo or recording within TAP lab or at a TAP lab operated activity.
    • Every person who is identifiable within TAP lab or at a TAP lab operated activity must be given the opportunity to explicitly opt out of the photo or recording, either verbally or through an explicit action.
  • For persons under 18, consent or opt-out must be obtained by both the individual and their guardian.
  • Explicit consent must be obtained from the licence owner or work owner, or they must be given the opportunity to explicitly opt out before any photo or recording is made where the work is the subject of the photo.
  • If a person in a photo or recording requests its deletion it must be deleted, or the person must be rendered unidentifiable.

Events, workshops, and within TAP lab

Attended cameras

Any camera being operated by a person with direct control over the taking of photos, videos, or other recording functionality must follow the consent policy above. Consent must be sought prior to taking any photo or recording.

Unattended cameras

In the case of any camera permanently or temporarily mounted for the purposes of photography or recording without direct intervention from the operator, the operator must take reasonable precautions to ensure persons entering the view of the camera are aware of its presence and the intended use of images captured. Where possible, a photo consent on entry is recommended.   Where is not possible to gain consent from all people in a photo or recording, any person for which consent has not been received must be anonymized.

Special-use cameras

TAP lab makes use of special-use cameras, these are permanently fixed or long-term cameras designated for a particular purpose. TAP lab shall keep a list of active special use cameras in Schedule 1

Surveillance Camera

These requirements do not apply to any council operated camera. A surveillance camera is any camera that is placed with the intent of monitoring TAP lab for safety, security, group activities or similar. A surveillance camera may or may not record or live stream.

General provisions

  • Any Surveillance camera must be approved by the Executive Committee
  • Members must be notified of any proposed camera and given an opportunity to raise concerns. This must be taken into consideration by the Executive Committee.     There must be clearly visible signage indicating the presence of a camera
  • Footage may not be live streamed or accessible outside TAP lab.

Recording and footage access

Any recorded footage is to be accessible only by the:
  • Chairperson
  • Secretary – Treasurer
  • Person authorised by the Executive committee to perform maintenance
When wanting to access the footage a request must be made to the TAP lab executive committee (this can be done via Slack or email). It must be approved by:
  1. One member of the TAP lab executive committee AND
  2. Either the Chairperson, Secretary or Treasurer
Any access to recordings must be recorded in a security access log maintained by the Executive. Acceptable reasons for footage access
  • Damage to equipment or property within TAP lab
  • Theft of equipment or property
  • Verifying reports of inappropriate behaviour
Recordings may not be used for
  • Publicity
  • Monitoring other groups or users of the space.
Recordings may only be kept for a reasonable time, and may only be used for the purpose they were collected and approved for.  

Equipment Monitoring

TAP lab may operate fixed cameras for the purposes of monitoring equipment operation and progress. If the camera is partially or fully intended to monitor the security of equipment, then the Surveillance camera clause shall also apply.
  • Equipment Monitoring cameras must be focused on the work area of the equipment
  • A sign must be visible near the equipment stating a camera is in use, and, if there is the potential for a person to be identified – the area covered by the camera.

Complaints

Any complaints or concerns should be addressed in the first instance with the operator or owner of the camera, if the complainant is uncomfortable doing this, or it does not yield an appropriate course of action a complaint should be raised with a member of the Executive Committee.  

Schedule 1: Special Use Cameras

This sets out the active special-use cameras, locations, areas of coverage and notes. This schedule may be updated when necessary, without going through the policy amendment process.
